Rental terms and conditions

OUR TERMS & CONDITIONS

These Terms and Conditions apply to all rentals. All rentals are subject to our Terms and Conditions a copy of which will be made available upon collection or delivery of the vehicle or trailer. Our Terms and Conditions are subject to change between booking and the time of rental.

VEHICLE HIRE

  • We are, for the purposes of this contract, referred to herein as “M65 Self Drive Limited “,”M65”, “we”, “our” or “us”.
  • You are the person or body corporate who is hiring from us a vehicle and equipment and for the purposes of this contract, you may be referred to herein as “you”, “your” or “the Hirer”.
  • These terms shall apply to the hire of any vehicle equipment and all services that we supply to you. We may change these terms without notice to you in relation to any future hire.
  • Any reference to the vehicle includes any and all accessories and additional products / equipment supplied as part of the vehicle hire.

  • All vehicles are subject to availability at the time of your order. If, between receipt of your order and the commencement of your hire the vehicle you have ordered becomes unavailable, we shall inform you at the earliest opportunity and arrange for an immediate refund of all sums paid to us in respect of the hire period to be made. We accept no responsibility nor liability to pay any compensation, costs or expenses where the performance of your contract with us is prevented or affected or you otherwise suffer any loss or damage as a result of events beyond our reasonable control. This includes, but is not limited to, any delays to and/or restrictions to your hire to which you may be subject. However, if your booking has to be cancelled as a result, we will provide a full refund as described above, and we shall be under no further liability in this regard.
  • All hire pricing is either per day (24hours) or 4 hours starting from the agreed collection time.
  • All prices shown on the price list and website are inclusive of VAT at the current rate.
  • Additional drivers are accepted at an extra cost.
  • Our VAT Registration number is 228 0542 25
  • Vehicle hire Prices include mainland UK breakdown cover and insurance (insurance is subject to excess).
  • We shall make every effort to ensure that prices and descriptions shown in our quotation or on our website are accurate at the time that you place your order. However, if an error is found, we shall inform you as soon as possible and offer you the option of reconfirming your order at the correct price or cancelling your order. If you decide to cancel, we shall refund to you any sum that has been paid by you to us.
  • Vehicle images on our literature and website and other promotional material are examples only – specific vehicles cannot be guaranteed.

  • An initial deposit of 100% of hire charges will be required to confirm a booking.
  • Should your plans change and you need to change your date of hire or vehicle type you can do this up to 24 hours before your hire period is due to commence except for rentals that commence on a Monday where 48 hours’ notice is required. If changes are made in line with the agreed notice period change of date will be free of charge and change of vehicle type will be subject to an extra payment or partial refund depending on the type of vehicle required. The deposit will be fully forfeited in the event of the Hirer’s giving less than the required notice period in accordance with these terms and conditions.
  • Should you wish to cancel your booking your initial deposit less an administration charge will be refunded in full if 24 hours’ cancellation notice is given except for rentals that commence on a Monday where 48 hours’ notice is required. The deposit will be fully forfeited in the event of the Hirer’s cancellation giving less than the required notice period, or failure to provide full payment or documents required in accordance with these terms and conditions.
  • We will give you a minimum of 48 hours’ notice in the event that we have to cancel your booking, Cancellation would only occur due to unforeseen circumstances and after every effort has been made to source an alternative vehicle and where a free upgrade would not be appropriate. Should this occur your initial deposit will be refunded in full.
  • Any refunds to be made will be repaid in the same way that the initial payment was taken from you.
  • If a cancellation or amendment to the booking is to be made this is to be done by way of a phone call to our main office during our normal office hours.
  • All hire charges have to be paid by credit or debit card, the card used to pay has to be present at vehicle collection \ hand over and must be in the name of the hirer.
  • Upon collection of the hire vehicle and equipment a deposit of £200 will need to be paid by credit or debit card to cover any damage to the vehicle during the hire period (refunded when vehicle is brought back in good condition).
  • Please note that the vehicle will not be made available to you until we are in receipt of cleared funds in respect of all sums due and payable to us for the hire services.
  • If the payment of any fees by you is not made in accordance with these terms, you will be deemed to have requested the termination of the contract and you hereby acknowledge that the vehicle reserved for you at the time of your order may be released by us for hire to any other customer without liability to you.
  • If you fail to pick up your vehicle on the day your rental is due to start, the deposit will be fully forfeited for us having held the vehicle for you without any rental transaction taking place.
  • The person hiring the vehicle agrees to fully forfeited the deposit in the event that the keys for the hired vehicle are lost or stolen or damaged (whether or not you are at fault for the loss, theft or damage)

  • Unless otherwise agreed, collection of the vehicle shall be made by you from our premises at Unit 1, Farrington Court, Burnley, BB11 5SS and on the date and at the time agreed for the commencement of hire when the booking was made.
  • Vehicles cannot be collected outside our normal business hours.
  • The period of hire shall commence on the date and time shown on the Rental Agreement and shall end on the date and time of this Agreement.  The period of hire may not be extended without our prior consent. Unauthorised extensions to the rental period will result in additional charges being incurred.
  • We will prepare a Vehicle Hire Condition Form which will specify the precise details of the vehicle, together with a summary of any damage noted by us prior to the commencement of your hire period. At the time of collection, you will be required to sign the Form to confirm your acceptance of the condition of the vehicle. Please ensure that you have read the Form carefully before signing the Form and thereby accepting the vehicle.
  • We will use all reasonable endeavours to have the vehicle available for collection on the date and time agreed but we shall not incur any liability whatsoever in the event of any delay arising from matters beyond our reasonable control.
  • All vehicles are subject to availability, if your chosen vehicle is not available we will offer you a free upgrade to the next vehicle group
  • Please note that, notwithstanding your payment of all sums owing to us in respect of the proposed hire, the vehicle will not be made available to you until we are reasonably satisfied with your forms of identification, Licence details and the vehicle will not be released until all such documents have been produced in accordance with these terms.

  • Our fuel policy is same too same, the amount of fuel will be shown on the Vehicle Hire Condition form at the start of the hire period, you are to return the vehicle with the same amount of fuel.
  • Refunds will not be made by M65 to you for excess fuel in the vehicle at the end of the hire period.
  • If you return the vehicle with less fuel than what was present at the start of the hire period you will be charged for the missing fuel at the end of the hire, this will be charged at a locally determined price. A surcharge will be added for using this facility.

  • Our vehicles have an allowance of 100 miles 4 hours, 200 miles per day, 400 miles per weekend, 1000 miles per week and 2000 miles per month (unless otherwise stated)
  • The term “unlimited mileage” assumes that you will not exceed our Mileage policy allowances, if you are going to exceed these amounts please discuss this with our office at time of booking.
  • We reserve the right to charge £0.16 pence per mile including VAT for excess miles above the allowance rates.

  • Prior to the release of the vehicle, you shall be required to provide to us the following valid original documents: –
    • Two forms of current ID one utility bill and either a council tax bill\bank or credit card statement (no more than 60 days old), this must show your current residential or business address, copies not accepted.
    • Current driving licence for the hirer and additional drivers, copies will not be accepted, if the licence does not show the hirers photograph then a valid passport will be required. The licences must: –
      • Have been held for a minimum of 24 months for the same class of vehicle as the hired vehicle.
      • Show the correct entitlement for the vehicle being hired.
      • Show your current address.
      • Be legible, we must be able to read and understand the licence presented and establish its validity.
      • EU licences must have the EU symbol.
      • Be valid and within date, expired licences will not be accepted.
    • In order to comply with our insurance company’s requirements, we require all drivers of hired vehicles to authorise us to check their driving licence details online, this is referred to as the GB Driving Licence Checking procedure and operates as follows: –
      • You can check your licence yourself online in advance or at our office when you collect your hire vehicle.
      • To perform the check, you will require your driving licence, national insurance number and post code.
      • Go to the website https://www.gov.uk/view-driving-licence
      • Log in using your full 16-digit driver number, national insurance number and postcode.
      • Choose to share your driving licence information, you will then be given a SHARE CODE, make a note of this code and bring this to our office, the share code is case sensitive so make sure you note it down correctly.
      • We will not be able to proceed with your hire until we have checked your licence details online, this is an insurance requirement.

  • Hire age range for all vehicles is 23-75 years.
  • A daily insurance surcharge will be added for drivers aged between 23-25 years and 70-75 years.
  • Drivers outside the age range may be accepted subject to insurance clearances (surcharges will apply)
  • Drivers with a Drink, Drug or Dangerous Driving Conviction within the last 5 years will not be accepted.
  • Drivers must have had a minimum of 24 months driving experience since obtaining a permanent licence in the UK or EU to drive a vehicle of the same class as the hired vehicle.
  • We can only accept drivers who hold a UK or EU driving licence. The following persons will not be accepted: –
    • Persons who have been convicted of an offence in connection with the driving of a motor vehicle or motorcycle and/or have had their driving licence endorsed or suspended or more than 6 penalty points imposed. “Spent” convictions, covered by the rehabilitation of offenders Act 1974 may be disregarded.
    • Persons who have had their insurance declined and/or renewal refused and/or special insurance terms imposed as a result of claims experience and/or have had their insurance or cover cancelled by any Motor Insurer.
    • Persons engaged wholly or partly in professional entertainment or professional sports persons.
    • Jockeys and persons connected with racing, gaming industry or press of any sort.
    • Undergraduates and/or students under 25 years of age.
    • Persons who, whilst driving, have been involved in more than one accident during the past 3 years.
    • Foreign Service Personnel other than persons holding a full UK/EU licence for two years or more.

  • We shall be under no liability in respect of any defect arising from fair wear and tear, wilful damage, negligence, abnormal working conditions, failure to follow our or manufacturer instructions (whether oral or written), misuse or alteration or repair of the vehicle without our prior approval.
  • Nothing in these terms shall affect your statutory rights as a consumer. If you are in any doubt as to the extent of your statutory rights as a consumer you should seek your own independent legal advice from an appropriately qualified person. If you have any other complaint about the hire services, you should notify us in writing at the address or email address above.

  • You shall during the continuance of this hire contract: –
    • Obtain, and ensure all necessary documentation and valid licenses to legally use the hire vehicle are in place and displayed in the vehicle if legally required. This includes and special licences or permits for the type of goods \ waste you are carrying or transferring.
    • Not use the hired vehicle for towing.
    • Be responsible for establishing whether a Tachograph is required and conform with all such legislation governing the use of Tachographs.
    • Ensure the vehicle is always left locked when unattended and that the keys are never left in an unattended vehicle, if a vehicle is stolen and you the Hirer cannot present the keys you will be liable for the full replacement vehicle cost.
    • Take all steps to ensure that the vehicle is secure from theft or damage.
    • To ensure loads are securely restrained and that the vehicle is in a roadworthy and safe condition prior to each journey.
    • Drive the vehicle with due care and attention and in accordance with all legal requirements.
    • Indemnify us against all fines, penalties and liabilities payable by us by virtue of your hire and/or use of the vehicle or arising in respect of any non-compliance or contravention of any transport, traffic or other law or regulations, together with any costs or expenses relating thereto incurred by such use of the vehicle.
    • The person hiring the vehicle agrees to report any accidents or thefts to the police and to M65 Self Drive Limited within 2 hours of any incident. Failure to comply with this will result in the agreed excess amount being doubled.
    • The person hiring the vehicle agrees to report any damage to the vehicle be it internal or external including the roof and undercarriage to M65 Self Drive Limited within 2 hours of any incident. Failure to comply with this will result in the agreed excess amount being doubled.
    • The person hiring the vehicle agrees to fully forfeited the deposit in the event that the keys for the hired vehicle are lost or stolen or damaged (whether or not you are at fault for the loss, theft or damage)
    • Accept liability for the full replacement value of the vehicle including any and all accessories and additional equipment supplied and the cost of replacing any tyres fitted to the vehicle – on a like for like manufacturer basis –  should those tyres be damaged in any way, whilst on hire to you.
    • Pay us the repair / replacement costs up to the full replacement value of the vehicle immediately upon demand. For each day after this, M65 Self Drive Limited shall charge the Hirer a full days hire charge for each day until such sums have been settled in cleared funds in full.
    • Not take or allow the vehicle to be taken out of mainland England, Scotland or Wales without our prior written authority and, in the event of that authority being given, only on such terms as we deem fit.
    • Not sell, assign, mortgage, lend, let on hire or otherwise dispose of or part with possession of the vehicle or part thereof nor attempt or purport to do so.
    • Not remove or interfere with any identification marks, livery or plates affixed to the vehicle.
    • Not tamper with the vehicle tracking equipment or monitoring cameras (if fitted)
    • Take all necessary steps at your own expense to retain and recover possession and control of the vehicle of which you lose possession or control.
    • The hired vehicle shall not be used for the carriage of goods of an explosive, dangerous or hazardous nature or for the carriage of goods or passengers for hire and reward.

  • You the Hirer “I further agree to be bound by the terms and conditions of the Insurance which I have seen and read or have had the opportunity to see and read”.
  • All vehicle hires are subject to a £750.00 Damage Excess and £1500.00 Write Off Excess (25 – 75 years) £1500.00 Damage Excess and £3000.00 Write Off Excess (23 – 24 years).
  • If an incident \ accident occurs and the dash camera inside the vehicle is found to have been tampered with or removed then the Excess charges will be doubled.
  • Neither any goods or livestock carried in or on the vehicle are insured by M65 Self Drive Limited. During the period of hire, vehicles will be used entirely at the Hirer’s own risk.
  • The hired vehicle shall not be used for the carriage of goods of an explosive, dangerous or hazardous nature or for the carriage of goods or passengers for hire and reward.
  • Breakdown cover for the mainland UK is included.
  • Collision damage waiver (CDW) is not included in the hire price this can be purchased at an additional cost to reduce your excess to a minimum. (CDW) is made available purely at the discretion of M65 and we reserve the right to withdraw this product at any time. (CDW) is not available to drivers under 25 years of age.
  • M65 reserve the right to have active tracking equipment and monitoring cameras installed to all our vehicles.
  • Some M65 vehicles may be fitted with towbars, these are not to be used and will render the vehicle insurance invalid.

  • Any expense incurred by us in repossessing the vehicle or in recovering possession of the vehicle on default of delivery by you under these terms will be reimbursed by you to us on demand.

  • The vehicle shall at all times remain the property of M65 Self Drive Limited and you shall have no rights to the vehicle other than as Hirer.
  • You shall not do or permit or cause to be done any matter or thing whereby our rights in respect of the vehicle are or may be prejudicially affected.

  • Unless otherwise agreed in writing, the return of the vehicle shall be made by you returning it at our premises on or prior to the date and time agreed for the expiry of hire shown on this Rental Agreement. Please ensure that you return the vehicle on time and in accordance with these terms. It is important that the vehicle is returned on time so that it can be prepared in readiness for release to other customers.
  • Vehicles must be returned to us in person and during our normal business hours. You remain responsible for any and all costs relating to the vehicle until it has been returned to us and accepted by us. In the event that a vehicle is left uninspected, the Hirer will forfeit their full deposit.
  • In the event that you do not return the vehicle on time and in accordance with these terms a penalty payment of £20 + VAT will immediately become payable to us for each hour period between the agreed expiry of the hire and the actual time of return (subject to a maximum daily penalty charge of £60 + VAT). You hereby authorise us to charge all such penalties against your credit \ debit card.
  • The vehicle must be returned to us cleaned, swept and hosed out where necessary and in a suitable condition to allow it to be re-rented immediately. There will be a penalty of £20 + VAT if the vehicle is not cleaned to our satisfaction. You hereby authorise us to charge all such penalties against your credit \ debit card.
  • Please note that NO REFUND or discount will be given where the vehicle is returned early.
  • No arguments will be entered into on the vehicles return.

  • We make no promises, whether express or implied, in relation to the accuracy of information on our website and any material downloaded from our website is at your own risk and we shall assume no liability for any loss or damage, whether direct or indirect, arising from your use of that information or material.
  • Nothing in these terms shall restrict our liability to you for: –
    • Death or personal injury caused by our negligence.
    • Liability for defective products under the Consumer Protection Act 1987.
    • Fraudulent misrepresentation.
  • In no event shall we be liable to you for any damages, including any lost profits or prize funds, entry fees, lost savings, loss of data or any indirect, special, incidental or consequential damages arising out of the hire services even if we have been advised of the possibility of such damages.
  • In no event shall we be liable to you for loss \ damage to any goods or livestock carried in or on the vehicle during the period of hire, vehicles are used entirely at the Hirer’s own risk.
  • Property placed in the vehicle is done so at your own risk and M65 takes no responsibility for it. It is your responsibility to check you have not left any personal property or effects in the vehicle before you return the vehicle to us. Any unclaimed property found and unclaimed will be disposed of 3 months after the end of the hire period.

  • You agree to be fully responsible for all claims, liability, damages, losses, costs and expenses, including legal fees on a full indemnity basis, suffered or incurred by or awarded against us and arising directly or indirectly as a result of any breach or default on your part in the discharge of your obligations under this hire contract.
  • Indemnify us against all fines, penalties and liabilities payable by us by virtue of your hire and/or use of the vehicle or arising in respect of any non-compliance or contravention of any transport, traffic or other law or regulations, together with any costs or expenses relating thereto incurred by such use of the vehicle.

  • We shall take all reasonable care to ensure that we comply with our obligations under the Data Protection Act 1998 so that details of your order and payment are kept secure. However, unless we are negligent, we shall not be liable to you for any unauthorised access to information supplied by you.
  • We shall only use the information you provide about yourself for the purpose of fulfilling your order.
  • Please read our Privacy Policy which sets out the purposes for which we intend to process your personal data. Please contact us at the address shown above if you do not already have a copy of our Privacy Policy.

  • We shall have the right to assign or otherwise delegate all or any of our rights or obligations under these terms upon notification to you.

  • Any failure by us to exercise, or any delay in exercising any of our rights under these Terms and Conditions or failure or delay in enforcing compliance with any clause of these Terms and Conditions shall not operate as a waiver or variation of that or any other such right; and no act or course of conduct or negotiation on our part or on our behalf shall in any way preclude us from exercising any such right or constitute suspension or variation of any such rights.

  • If any clause of this Terms and Conditions or the application thereof to any party or circumstance shall, to any extent, now or hereafter be or become invalid or unenforceable, the remainder of these Terms and Conditions shall not be affected thereby and every other provision of these Terms and Conditions shall be valid and enforceable to the fullest extent permitted by law.

  • None of the provisions of these Terms and Conditions of Business and any Schedule thereto is intended to be for the benefit of, or enforceable by third parties (other than permitted assignees of M65 Self Drive Limited who shall be entitled to enforce the provisions of these Terms and Conditions of Business and any Schedule thereto as if original parties to it) and the operation of the Contracts (Rights of Third Parties) Act 1999 is excluded.

  • These Terms and Conditions are governed and construed in accordance with English Law and the English Courts shall have exclusive jurisdiction in the event of any disputes arising in connection with these Terms and Conditions and you and M65 Self Drive Limited agree to submit to the exclusive jurisdiction of the Courts of England and Wales.

  • All complaints should be made to our registered office at the address or email address above.

  • M65 Self Drive may use personal information in an aggregate form (i.e., not individually attributable to you) for its business analysis, operational, marketing and other promotional purposes.
  • If we hire other companies to provide some products or services on our behalf, then we will only provide those companies the personal information they need for the Identified Purposes, and we will limit their rights to use and further disclose your personal information as appropriate in the course of their work for us.
  • M65 Self Drive Limited limits its collection of personal information to only that information which is necessary for the Identified Purposes.
  • M65 Self Drive does not sell, rent or disclose your personal information to anyone else, except: –
    • To someone you have designated to act as your agent, for one or more of the Identified Purposes.
    • To our employees, independent contractors, consultants, business associates, suppliers and agents, acting on our behalf for any of the Identified Purposes.
    • When required to do so by law.
  • We keep your information stored under lock and key and on database systems protected by passwords on premises secured by 24/7 alarms.
  • If you follow links to other websites from our website, we do not control those sites and are not responsible for the use of your data by those site owners.
